CAMAP Forum Access Agreement
As a condition of access to and participation in the Canadian Association of MAiD Assessors and Providers (“CAMAP”) Forum (“Forum”), CAMAP requires members to accept and adhere to the terms of the following Forum Access Agreement (“Agreement”). “Members” include members of CAMAP and all others who participate in the Forum through agreements with other organizations.
PLEASE READ THIS FORUM ACCESS AGREEMENT CAREFULLY BEFORE USING THE CAMAP FORUM. BY ACCESSING OR USING THE CAMAP FORUM, YOU AGREE TO BE BOUND BY ALL THE TERMS OF THIS AGREEMENT IN THEIR ENTIRETY. IF YOU DO NOT AGREE TO ALL THE TERMS AND CONDITIONS INCLUDED IN THIS AGREEMENT, THEN YOU MAY NOT ACCESS OR USE THE CAMAP FORUM AND MUST EXIT IMMEDIATELY.
CAMAP makes the Forum available to interested members for the purpose of providing an exchange of information relating to topics about the practice of medical assistance in dying (“MAiD”), patients and families facing grievous and irremediable medical conditions and the healthcare and other professionals that care for such patients and families.
The CAMAP Forum is intended to be a closed forum to be used solely by a community of professionals with common concerns and to provide these professionals with a confidential means to seek guidance from each other. To meet this purpose, the Forum encourages a frank and free-flowing exchange of both facts and opinions. Any posted information must be related to the purposes of the Forum. Forum members shall not cause a copy of a Forum submission or posting to be disseminated to any other person, nor shall they cause the contents of a submission or posting to be attributed to its author except in discussions with other CAMAP Forum members who are subject to this Agreement.
CAMAP will deny access to the Forum to any member who has not agreed to the terms of this Access Agreement and reserves the right to terminate access to any member who does not abide by the rules and terms contained therein.
CAMAP believes that anonymous postings are neither necessary for purposes of this Forum nor consistent with the professional level of dialogue expected. Therefore, the member’s name will be posted with any and all postings.
CAMAP reserves the right to monitor, moderate and administer the Forum and, in its sole discretion, decline to post and/or remove messages or materials that it believes do not comply with the terms of this Agreement or are not in the best interests of CAMAP. CAMAP also reserves the right to disallow the use of any particular screen name or e-mail address, or to terminate any member’s posting privileges at any time.
Any views expressed on the Forum are those of the individual members. They do not and should not be construed as representing the views of CAMAP. CAMAP makes no warranty, guarantee, or representation as to the accuracy or sufficiency of the information posted to the Forum, whether posted by CAMAP or any third party, and CAMAP assumes no responsibility or liability regarding the use or misuse of such information for any purpose.
The information, opinions, and recommendations presented within the Forum are for general information only. Such information should not be considered professional advice and is not intended to replace consultation with a qualified professional. Members must comply at all times with the applicable standards for privacy of individually identifiable health information and other electronic or digital information security rules established by the federal government, provinces and other regulators. Information posted to the Forum is not treated as confidential and, therefore, should not identify any patient by name or other identifying features, characteristics or any other individually identifiable patient health information. Since information posted to the Forum may be downloaded, reproduced, and disseminated without the knowledge of the senders, members should use extreme care when submitting or posting information.
Postings are not: (i) recommendations or endorsements of a course of treatment for a particular patient; (ii) professional opinions or advice; or (iii) practice guidelines or other policies intended to supplant a physician’s judgment with respect to particular patients or clinical situations. Postings are provided for informational purposes only to facilitate discussion on a given topic.
Members should exercise common sense, civility and courtesy in submitting comments or materials for posting on the Forum. Inappropriate submissions will include, for example, comments or materials that: (i) make false or defamatory statements about others; (ii) are obscene, vulgar, abusive, patently offensive or hateful (iii) can be reasonably perceived as threatening; (iv) harass or discriminate on the basis of race, religion, nationality, ethnicity, gender, sexual preference or other protected factors; (v) contain advertising or spam; (vi) are off-topic or (vii) are invasive of the privacy rights of others (e.g., by including addresses, telephone numbers or other personal information about third persons without their consent). Anyone who believes that a posted message is objectionable is encouraged to immediately notify the CAMAP Forum Administrator.
Members who post files, articles, or other documents must ensure that they do not violate any copyright, trademark or other intellectual or proprietary rights. This may be accomplished, for example, by obtaining the express consent of the owner of the rights. Unless expressly provided otherwise, members represent that any and all material provided to CAMAP for the Forum may be further published, displayed, copied, downloaded, transmitted, or modified by CAMAP or any Forum members.
Members are prohibited from using the Forum for illegal purposes or in any manner that violates CAMAP’s constitution, bylaws, purposes or any other policies, procedures, rules or regulations of CAMAP. Members are prohibited from posting commercial messages advertising or selling goods or services.
Members must respect the security of the Forum and may not attempt to gain access to areas private to CAMAP or other members. A member may not upload, post or transmit any material containing software viruses or any other computer code, files or programs designed to interrupt or limit the functionality of the CAMAP’s website, forum hosting software, equipment or other connected software and/or hardware. Members may not attempt to decompile, reverse engineer, modify or hack the hosting software to defeat or overcome any encryption or digital rights management technology implemented by the CAMAP, or to harm, disable, overburden, misuse or interfere with any other party’s use of the Forum or CAMAP website, servers, networks or systems.
Unless specifically stated otherwise, CAMAP does not endorse, approve, recommend, or certify any information, product, process, service or organization presented or mentioned on the Forum, and information from the Forum should not be referenced in any way to imply such approval or endorsement.
The site and the content are provided “as is” and “as available”. CAMAP expressly disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. CAMAP makes no warranty that the Forum, or any computer, server, device, software, or other technology associated with the Forum, is free of viruses, worms, or other elements or codes that manifest contaminating or destructive properties.
Each member having access to the Forum shall indemnify and hold CAMAP harmless from and against any and all liability, claims, damages, losses, costs and expenses (including reasonable attorney’s fees) relating to their acts or omissions or to materials or information they transmit in connection with the use of the Forum.
While CAMAP has a policy to resist any disclosure of Forum communications to those who are not Forum members, CAMAP cannot assure Forum members that their communication can be protected from disclosure compelled by a subpoena or other legal process. A member subject to legal process seeking disclosure of Forum communications will promptly notify the CAMAP Forum Administrator of the communications being subpoenaed. The CAMAP Forum Administrator will notify any Forum members who have submitted postings that may be disclosed. CAMAP and/or the members involved may assert whatever privacy, privilege or other rights they have to nondisclosure. CAMAP and the member or members involved in the legal action may disclose the submissions to their legal counsel to receive legal advice or representation, if necessary, without violating the terms of this Agreement, provided that such disclosure will be maintained by the member and member’s counsel as privileged lawyer-client communication to the extent permitted by law.
CAMAP is incorporated as a non-profit society in the Province of British Columbia. This Agreement shall be governed in all respects by the laws of the Province of British Columbia. In addition, in the event of legal proceedings under this Agreement, members consent to be subject to the exclusive jurisdiction of the courts of the Province of British Columbia.
CAMAP reserves the right to modify the rules of this Agreement from time-to-time in the best interests of CAMAP, provided all members are notified prior to any such change.
